Terms of Use

These Terms of Use ("Terms") govern your use of the Fountain AI mobile application ("App") operated by Lucid Studios LLC ("we," "our," or "us"). By downloading or using the App, you agree to these Terms.

1. Use of the App

Fountain AI is an AI-powered photo and video generation application. You may use the App to create images and videos from text prompts or by editing uploaded photos.

You agree not to use the App to:

• Generate illegal, harmful, threatening, abusive, or hateful content.
• Create content that infringes on the intellectual property rights of others.
• Generate deepfakes or misleading content intended to deceive others.
• Violate any applicable laws or regulations.

2. Account

You must sign in with Apple or Google to use the App. You are responsible for maintaining the security of your account and for all activities that occur under it.

3. Subscriptions and Payments

Fountain AI offers auto-renewable subscription plans:

• Weekly Plan: Billed weekly after a 3-day free trial.
• Yearly Plan: Billed annually after a 3-day free trial.

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID Account Settings.

No refunds will be provided for any unused portion of a subscription period. All refund requests must be directed to Apple.

4. Usage Limits

Subscribers are subject to monthly generation limits to ensure fair usage and service quality. Current limits are displayed within the App and may be adjusted at our discretion.

5. Content Ownership

You retain ownership of the content you create using the App, subject to the following:

• AI-generated content may be subject to the terms and limitations of our AI service providers.
• We do not claim ownership of your generated content.
• You are responsible for ensuring your use of generated content complies with applicable laws.

6. Intellectual Property

The App, including its design, features, and branding, is the property of Lucid Studios LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be uninterrupted or error-free.
• AI-generated content will meet your expectations or requirements.
• The App will be available at all times.

8. Limitation of Liability

To the maximum extent permitted by law, Lucid Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
